[社会]军工企业夫妻携国家机密资料跳槽藏于家中获刑(08/29 12:15)

　　作为军工企业员工，保密工作是否落实到位，事关企业生存与发展，更对国家的安全与利益产生深远影响。
　　原西安某科研单位工作人员袁某、孔某二人系夫妻，大学毕业后，二人在同一单位工作，在工作期间，私自将属于国家机密的某些国防电子产品的技术说明书、技术图纸、程序和图纸软盘等资料带回家中。后来，二人被高薪聘请，跳槽到南京某通讯研究所工作，并将非法获取的秘密图纸和资料藏匿于南京个人住所。案发后，办案人员在其住处查到了存有国家机密的软盘、图纸、原始试验记录本和技术说明书等物。袁某和孔某非法窃取国家秘密，其行为已经构成了非法获取国家秘密罪。根据《刑法》有关规定，法院判决袁某和孔某犯非法获取国家秘密罪，获有期徒刑一年、缓刑两年。
　　《保密法》明确规定，国家对涉密人员实行脱密期管理，从一般涉密人员到核心涉密人员，其脱密期为1-5年不等，脱密期结束后每个公民仍有义务和责任保守国家秘密。案例中袁某和孔某保密观念不强，保密意识淡薄，致使其行为违反保密工作制度。
　　涉密载体管理和互联网信息发送是保密工作的重点任务和薄弱环节。各单位需进一步完善相关保密工作制度和管理程序，加大对企业员工的保密意识及知识教育，杜绝失、泄密隐患，切实保护国家秘密。(吴雅琴)
